Terms of Service
Effective date: July 11, 2026 · Last updated: October 6, 2026
These Terms of Service ("Terms") are a binding agreement between you and
Redoubtable LLC, a Virginia limited liability company ("Redoubtable,"
"we," "us," or "our"), governing your use of the
Raretell mobile application and related services (together, "the App"
or "the Service"). "Redoubtable Parties" means Redoubtable and its
members, managers, officers, employees, agents, and service providers.
PLEASE READ SECTIONS 3 (WHAT THE SERVICE IS — AND IS NOT), 11 (DISCLAIMERS), AND
12 (LIMITATION OF LIABILITY) CAREFULLY. THE SERVICE IS NOT AN EMERGENCY OR MEDICAL SERVICE AND HAS
INHERENT LIMITATIONS.
By creating an account, or by downloading, accessing, or using the App, you agree to these Terms and
confirm that you are at least 18 years old. Our Privacy Policy explains how we
handle information. If you do not agree, do not use the App.
1. Who may use the Service
You must be at least 18 years old and able to form a binding contract to create an
account. You may set up and use the App to help look after another person (for example, an aging parent),
provided you have that person's knowledge and consent and the authority to do so.
2. Your account
Your account is keyed to an identifier generated on your device rather than to a password. You
are responsible for the device and for maintaining access to your account. To move the account to
a new phone, we send a code to the confirmed backup email address on the account; if you lose
access to both the device and that email address, you may lose access to the account and any
coverage it provides. Keep your backup email current. You are responsible for the activity that occurs
under your account.
3. What the Service is — and is not
Raretell is a passive notification tool. Your phone periodically reports signs of
activity; our server holds a timer, and if activity stops for longer than the waiting period you have
chosen and you do not respond to a check-in, the Service tries to reach you and then notifies the emergency
contacts you have designated. You must read and accept the following about what the Service can and
cannot do:
- It is NOT an emergency service and NOT a medical device. The Service does not
contact 911, emergency services, police, fire, or medical responders. It notifies the human contacts
you choose, who then decide whether and how to act. The Service is not a substitute for a medical alert
system, a personal emergency response system, a wearable fall/heart monitor, or professional medical or
caregiving services.
- It detects prolonged silence, not acute events. You choose how long the Service
waits before it acts — from one hour to seven days. A longer waiting period means a
longer time before anyone is told. The Service cannot detect a fall, seizure, cardiac
event, or any sudden or minute-scale emergency. What it is designed to do is make it less likely that
you go undiscovered for a long time — not to bring rescue within minutes.
- Detection takes time and is not guaranteed. By design the Service trades speed for
running invisibly in the background. Check-ins and alerts may be delayed beyond your waiting period or
may not be delivered at all, for reasons including (without limitation) your phone being off, dead, or
without network; iOS suspending background activity; permissions being denied or revoked; email/push
delivery delays or failures; errors in our software; or outages of Apple, Cloudflare, or other
third-party services.
- Reliability depends on your configuration. The Service works only as well as the
signals and permissions available to it. Keeping Health, Notifications, and (optionally) Location
permissions enabled, keeping your device charged and connected, keeping your subscription active, and
keeping at least one confirmed emergency contact current are necessary for the Service
to function as intended.
- Email and push are "soft" channels. Alerts are delivered by push notification and
email, which can be delayed, filtered as spam, or missed. The Service does not currently send SMS or
voice calls.
You accept these limitations as a condition of using the Service, and you use the Service at
your own risk. Do not rely on the App as your sole safety measure, and do not use it where failure
to detect or alert could lead to death, personal injury, or other serious harm without an independent
backup.
4. Your responsibilities
You agree to:
- Keep the permissions and device conditions the Service needs (Section 3) in place if you want it to
function as intended.
- Maintain at least one confirmed emergency contact if you want to be "covered," and keep your
contacts' information and your backup email current.
- Only add another person as an emergency contact or observer if you have their
permission to share the relevant information with them and to contact them. You are
responsible for having any necessary consent.
- Provide accurate information and not misuse the Service.
5. Emergency contacts and observers
- Contacts are added by a double opt-in: we email an invitation, and the person must
accept before they receive alerts or count as coverage. A contact can opt out at any time via a link in
every alert email; if they do, your coverage may be reduced and we are not responsible for that
reduction.
- Observers are people allowed to view a coarse status ("all's well," "away," or
"trying to reach them"). You can add one by email, or share a request link that lets someone ask;
nobody can view your status until you have added or approved them, and they sign in with their own
email address. You can remove an observer or replace your request link at any time.
- Contacts and observers act for themselves, not for us. They are not our employees
or agents, we do not train or supervise them, and we have no control over whether or how they respond
to an alert.
- By adding a person, you represent that you have the right to share their contact information with us
for this purpose.
6. Subscriptions, free trials, and billing
- Raretell is a subscription. Monitoring and alerts are provided while you have an
active subscription, a free trial, or a complimentary plan we grant. A new subscription may begin with
a free trial; unless you cancel before the trial ends, the paid subscription begins and renews
automatically.
- When a subscription ends, monitoring stops, and we try to tell everyone first. Ordinarily,
Raretell keeps monitoring for seven days after your subscription ends and tells you the date it will
stop. We will not stop while an alert about you is in progress; it stops once that is resolved. When it
stops, we try to tell you, and every emergency contact who has accepted, that Raretell is no longer
watching for you — but, like every alert, those notices can be delayed or missed, and monitoring
ends on schedule regardless. After that, Raretell does not alert anyone if you go quiet, until you
subscribe again.
- Exceptions to the seven days. If you move your subscription to a different Raretell
account, the account it leaves stops being monitored right away (or once any alert in progress is
resolved) unless something else covers it; the App tells you this before you confirm. Monitoring also
ends when you delete your account or turn monitoring off yourself, and as described in Sections 10 and
14.
- Purchases in the iOS App are processed by Apple. In-app purchases are governed by
Apple's terms, including its auto-renewal, billing, cancellation, and refund policies. We do not
receive your full payment-card details. Except where required by law or Apple's policies, payments
are non-refundable. Deleting your Raretell account does not cancel an Apple
subscription; cancel it in your Apple ID settings.
- Sponsor-paid coverage. If we offer it, a paid plan may cover someone other than the
payer only when the payer explicitly assigns that coverage and the covered person accepts or otherwise authorizes
the relationship. Being an emergency contact or observer is free and does not make you responsible for
payment.
- We may change plan features and pricing prospectively. We will tell you before a change reduces what
an active subscription includes.
7. Acceptable use
You agree not to: use the Service for any unlawful purpose; harass, surveil, or monitor any person
without their knowledge and consent; add contacts or observers who have not consented; attempt to breach,
overload, reverse engineer, or interfere with the Service or its security; or use the Service to send
unwanted communications to others.
8. Intellectual property
The App, including its software, design, text, and logos, is owned by Redoubtable and protected by
intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable
license to use the App for its intended purpose, subject to these Terms. You retain your own data; you
grant us the license necessary to operate the Service and deliver alerts on your behalf as described in
the Privacy Policy.
9. Third-party services
The Service relies on third parties including Apple (device platform, push
notifications, and payment processing) and Cloudflare (hosting, storage, and email
delivery). Your use of Apple's services is subject to Apple's terms. We are not responsible for
third-party services, and their failures or outages may affect the Service (see Sections 3, 11, and 12).
You must comply with any third-party terms that apply when you use the App, such as your wireless
carrier's.
Apple-required terms
- Acknowledgement. These Terms are between you and Redoubtable only,
not with Apple. Redoubtable, not Apple, is solely responsible for the App and its
content.
- Scope of license. The license in Section 8 lets you use the App on Apple-branded
products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and
Conditions.
- Maintenance and support. Any maintenance or support we choose to provide is our
responsibility. Apple has no obligation to provide any maintenance or support for the App.
- Warranty. To the extent any warranty is not effectively disclaimed, if the App fails
to conform to it you may notify Apple, and Apple will refund the purchase price (if any) for the App to
you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the
App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to
conform to any warranty are governed by these Terms, including Sections 11 and 12.
- Product claims. Apple is not responsible for addressing any claims by you or a third
party relating to the App or your possession or use of it, including product-liability claims, claims
that the App fails to conform to any legal or regulatory requirement, and claims under
consumer-protection, privacy, or similar law.
- Intellectual property. If a third party claims that the App or your use of it
infringes their intellectual-property rights, Redoubtable, not Apple, is responsible for investigating,
defending, settling, and discharging that claim.
- Legal compliance. You represent that you are not located in a country subject to a
U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S.
Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party
beneficiaries of these Terms and, once you accept them, may enforce them against you.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your
access if you breach these Terms, if required by law, or if we discontinue the Service. The
Service is not promised indefinitely, and these Terms do not require us to operate a historical version,
preserve historical features, or maintain compatibility with an old App version forever.
For a planned discontinuation, where reasonably practicable we will state the date coverage ends and
give advance notice through one or more channels available to us: the App, push notification, your backup
email, our website, and confirmed emergency-contact email addresses. A confirmed contact may be told
because they must not assume they remain part of an operating safety net. These are soft channels and
delivery cannot be guaranteed. At the stated time, monitoring and alerts stop even if a notice was missed or
the App was not opened.
For an Apple subscription, we will stop new sign-ups and renewals and provide paid service through the
period required by our agreement with Apple and applicable law. After the Service ends, remaining account
data begins deletion after the finite post-service period in the Privacy Policy. Sections 3, 5 (contacts
and observers act for themselves), 6 (as to amounts owed), 8, 9, 11, 12, 13, 15, and 16, and any other
provision that by its nature should survive, survive termination.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER
EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE REDOUBTABLE PARTIES
DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE,
ERROR-FREE, OR THAT ANY CHECK-IN, PROMPT, OR ALERT WILL BE DETECTED, GENERATED, OR DELIVERED. You
acknowledge the inherent limitations described in Section 3.
No duty to rescue. The Redoubtable Parties do not undertake to watch over you, to
contact or dispatch emergency services, to verify your safety, or to ensure that any contact receives,
reads, or acts on an alert. Status shown in the App or on any page (including that you are "covered")
describes the Service's configuration at that moment; it is not a guarantee that an alert will be sent or
received.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Redoubtable Parties will not be liable for any indirect, incidental, special,
consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other
intangible losses.
- The Redoubtable Parties will not be liable for any injury, death, property damage,
or other harm arising from the Service's failure to detect inactivity, failure to generate a
prompt, or failure to deliver an alert, or from any delay in doing so, including failures
caused by device, network, permission, iOS, software, or third-party conditions.
- The Redoubtable Parties' total aggregate liability for all claims arising out of or
relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the
Service in the twelve (12) months before the event giving rise to the claim, or (b)
US $50.
These limitations apply whatever the legal theory — contract, tort (including negligence), strict
liability, or otherwise — even if we were told the damage was possible, and they apply to claims brought by
you or by anyone claiming through or on behalf of you, including your heirs, estate, and personal
representatives. They reflect the price of the Service and are an essential part of the bargain between
us.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, for
death or personal injury caused by our negligence where such limitation is prohibited).
13. Indemnification
You agree to indemnify and hold harmless the Redoubtable Parties from any claims, damages, liabilities,
and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of
these Terms, or your violation of any law or of the rights of a third party — including a person you added
as a contact or observer without proper consent.
14. Changes to the Service and these Terms
We may modify the Service or these Terms prospectively. For a material change, we will state an
effective date and provide notice appropriate to its effect, using the channels described in Section 10
where coverage may be reduced. We do not undertake to operate both the former and revised Service
indefinitely. If a change cannot be provided safely under an older version or without new agreement, you
may need to update or accept the revised Terms to continue; otherwise monitoring may end on the stated
date, and the App must not continue to claim coverage.
If a change to information practices requires affirmative consent, the new processing will remain off
until consent is obtained. A material change takes effect on the date stated in its notice; other changes
take effect when posted. Either way, a change applies only going forward and does not apply to a dispute
that arose before it took effect.
15. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard
to its conflict-of-laws rules.
- Talk to us first. Before bringing a claim, you agree to email us a description of it
and give us 30 days to try to resolve it informally. This does not prevent either of us
from asking a court for urgent relief to prevent immediate harm, or you from contacting a government
agency.
- Where. Either of us may bring an eligible claim in small-claims court. Otherwise,
the exclusive venue for any dispute will be the state courts located in
Arlington County, Virginia, or the United States District Court for the
Eastern District of Virginia, Alexandria Division, and you consent to the personal jurisdiction of
those courts.
- When. To the extent permitted by law, any claim arising out of or relating to the
Service or these Terms must be filed within one (1) year after it arose, or it is
permanently barred. That year does not run during the 30-day period above, and this deadline does not
shorten any period that applicable law says cannot be shortened.
Nothing in this section deprives a consumer of the protection of mandatory provisions
of the law of the place they live.
16. General
- Entire agreement. These Terms, together with any terms presented when you purchase a
subscription, are the entire agreement between you and us regarding the Service. Our
Privacy Policy describes our information practices.
- Electronic communications. You agree that we may give you notices and other
communications electronically — in the App, by push notification, by email to your backup address, or
on our website — and that they satisfy any requirement that they be in writing.
- Severability. If any provision is unenforceable, it will be enforced to the maximum
extent permitted and the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms; we may assign them in connection with a
merger, acquisition, or sale of assets.
- Force majeure. We are not liable for failures caused by events beyond our
reasonable control.
17. Contact
